The story goes like this: a Roman emperor named Constantine gathered church leaders at Nicaea, and the men in that room voted on which books would count as Scripture. Applied to the Old Testament, the story has a timing problem it cannot survive. Israel was already copying, guarding and citing these books as the word of God long before there was a church to hold a council. No vote created them. People who tested them over generations recognized them, and those tests can still be examined.
That answer is a claim, and it deserves checking like any other. The fair way to check it is to ask what the evidence would look like if the council story were true, and then compare that with the record.
What Would Have to Be True for the Council Story to Work?
If a church council created the Old Testament, certain things should show up. Before that council, no one should have a settled sense of which writings carried God’s authority. The writings should be silent about one another. No one should have been responsible for protecting a particular set of texts. And Jesus and his first followers should treat Israel’s writings as an open, unsorted pile.
If the story is wrong, the evidence should point the other way: a recognized body of writings, custodians assigned to protect it, and people citing it as authoritative well before any church gathering.
One limit belongs at the start. The conversation behind this article, between Lisa Fields, founder of the Jude 3 Project, and Old Testament scholar Dr. Paul Wegner, never discusses Constantine or Nicaea. Nothing here reconstructs what that council did or did not debate. The council story is tested by chronology: whether the Old Testament existed as a recognized collection before any church council could have voted on it.
Was There a Recognized Collection Before the Church?
The first evidence sits inside the Old Testament itself. In Daniel 9:2 the writer says he understood from the books the number of years the word of the Lord had revealed to Jeremiah the prophet. A book in the collection treats another prophet’s written words as carrying the word of the Lord. Wegner points to this kind of reference: Daniel speaks of a group of books, and Jeremiah’s writing is among them. The verse does not list every book, but it places the act of recognizing God’s word inside Israel’s own history.
Jesus offers the next layer. He tells his disciples:
“These are the words which I spake unto you, while I was yet with you, that all things must be fulfilled, which were written in the law of Moses, and in the prophets, and in the psalms, concerning me” (Luke 24:44).
He speaks of these writings as a known body with recognizable parts, and he expects his hearers to know what he means. Wegner adds that the New Testament states plainly that Moses wrote the law. Whatever a later church council discussed, it could not have originated a collection Jesus was already citing as Scripture.
Physical evidence comes last. Wegner describes caves found in Israel, at Qumran, beginning in 1947, that held ancient biblical manuscripts. He dates most of them to roughly 150 years before Christ and later, and reports that one of the three major Isaiah scrolls is almost exactly like the Isaiah text read today. Those dates are his assessment and can be checked against other scholarship. If they hold, Isaiah was being copied with care before Christianity existed. Copying, though, proves only that a book was valued. It does not show where the edges of the collection lay, a gap taken up below.
Who Actually Kept the Books?
The council story imagines gatekeepers who chose. The record Wegner presents describes a different kind of gatekeeper, one whose job was to keep. “The nation of Israel had a whole group of scribes that were set aside to protect the revelation that God had given them,” he says. The scribes who appear alongside the Pharisees in the New Testament, he suggests, were most likely people who copied Scripture, which is where the title came from.
The order of events matters here. Recognition came first, and protection followed: “Once a book was determined to be divine revelation and from God, then they protected it.” A writing joined the protected collection because it had already been judged to be from God. Filing it did not give it authority. On this account, recognition happened book by book across Israel’s history, not in a single meeting.
Copying rules preserved in the Talmud show what protection meant in practice, according to Wegner. A page with three mistakes had to be thrown away and rewritten. A copyist who made an error while writing the name of God had to discard the page. A scribe writing the divine name was not to stop and return a greeting even if a king greeted him. The temple kept three scrolls of the Torah, and when two agreed against the third, the third was corrected. These are the habits of people trying to keep a text from changing, not people deciding what it ought to say.
How Did Anyone Know a Book Was From God?
Without a vote, recognition needed criteria. Wegner describes about four or five:
- The prophet had to be legitimate, a person the community recognized as someone God had inspired.
- The writing could not contradict itself or other Scripture. In Wegner’s words, “If there’s contradictions in it, or as it compares to other Scripture, then it can’t be from God.”
- It had to claim to be divine revelation, as the prophets do when they open with a vision from God or the word of the Lord coming to them.
- It had to fit with the rest of Scripture, saying something God would say.
The first test carries the most weight in his account: was this a true prophet of God, and did what he said come true? Unlike a preference, that test can be checked against events, and the Old Testament sets it out itself:
“When a prophet speaketh in the name of the LORD, if the thing follow not, nor come to pass, that is the thing which the LORD hath not spoken, but the prophet hath spoken it presumptuously: thou shalt not be afraid of him” (Deuteronomy 18:22).
A community holding that standard could not simply keep the books it liked. It had to watch what happened.
Isaiah shows the test at work. The prophet, Wegner says, “gives short-term prophecies so that you can trust him on the long-term prophecies.” He locates near-term predictions in chapters 6 through 9. When those came true, they gave grounds to trust the far-off promises of chapter 40. Isaiah 41 makes the principle explicit when God challenges the idols: “Shew the things that are to come hereafter, that we may know that ye are gods” (Isaiah 41:23). Wegner reads the passage as making knowledge of the future the mark of the true God. If that reading is right, the test of fulfilled prophecy did not originate with the scribes. It comes from the books’ own claims about what separates God from false gods.
Here the evidence has a gap, and Fields named it: not every Old Testament book was written by a prophet, and some have no known author. The tests fit the prophetic books most cleanly. For anonymous books, the weight falls on consistency with revelation already recognized. That is a real criterion, but it is harder to check than a fulfilled prediction.
If Scribes Edited the Text, Didn’t Someone Shape It After All?
This is the strongest form of the objection, because the text does show signs of later hands. Deuteronomy 34:10 says, “And there arose not a prophet since in Israel like unto Moses.” That line looks back across a stretch of time and makes little sense written the day after Moses died. Wegner notes that Jewish tradition in the Talmud credits Joshua with the closing account, and he sees no problem with the next prophet finishing the book. Genesis also uses the name Dan (Genesis 14:14) for a city that, according to Joshua and Judges, got that name only after the conquest (Judges 18:29). His explanation is that copyists updated the name so readers would know the place. “I don’t have a problem with a scribe trying to help keep the text accurate,” Wegner says.
Some changes went further. In one case Wegner describes, a man in Judges was linked to the line of Moses, and scribes, embarrassed by the connection, added a letter that turned the name into Manasseh (Judges 18:30). They wrote that letter above the line, so readers could see it had been added.
That is genuine counterevidence to the idea that scribes never touched anything. It also shows how small and how visible the changes were. Updating a place name, finishing an account of a death or marking a reverent adjustment is a long way from choosing which books exist. People who control a collection for their own ends do not usually leave marks pointing to their edits.
Fields made a related point about the King James translation: “Most people, if they’re trying to manipulate something, they manipulate it in their favor.” Wegner agreed: “It doesn’t do any good to manipulate it if you’re not gonna do it in your favor.” Apply that test to the scribes. Their embarrassment over Moses was strong enough to prompt a raised letter, yet they left the change in plain view.
The objection also has a moral edge. The council story often assumes the men who handled the books were powerful and untrustworthy. Fields observed that Jesus rebuked the scribes, the people who spent the most time with God’s word, without treating his rebuke as a reason to doubt the text. Wegner agreed that their failure was not inaccurate texts but not living by what they copied and read. The flaws of the custodians and the reliability of what they kept are separate questions, and Jesus kept them separate.
Where Does the Evidence Run Out?
The boundary of the collection is the first open question. Copying a scroll shows a community valued it, not that the list of recognized books was closed. The evidence here establishes that a recognized core existed before the church. It does not trace exactly when the edges were fixed, and it does not settle every later debate over particular books.
Apparent discrepancies are the second. “I know there’s still a couple of difficulties that still we don’t know for sure what the answer is,” Wegner admits. Most, he believes, can be worked out, and he points readers to Gleason Archer’s Encyclopedia of Bible Difficulties while noting he does not always agree with Archer’s answers. His own example is the Passover lamb (Exodus 12:9; Deuteronomy 16:7): he reads one instruction against boiling it as fitting the wilderness, where water was scarce and sometimes bad, and a later instruction as fitting life in the land. That is an explanation he proposes, not a settled fact.
Authorship is the third. Many scholars divide Isaiah among several authors because chapter 40 addresses the return from Babylonian exile, roughly 150 years after Isaiah’s day, and prophets usually spoke to their own generation. Wegner answers that Isaiah was written to a nation, not one listener, so a message meant for a later generation of that nation makes sense. He also points to repeated introductions and refrains that, in his view, tie the book together. His sharpest charge concerns method: “Usually when they bring in these later authors, there is no evidence anywhere else other than their logic that argues that there’s somebody else writing these books.”
Beneath that charge sits a disagreement about worldview. “It is a unique book. It is special, it has divine authority behind it. No other book has that,” Wegner says. A reader who rules out prediction in advance will date prophecies after the events they describe. A reader open to prediction will not. Manuscripts alone cannot settle that difference.
What the Record Changes
The question “who decided?” assumes there was a decider. The record points instead to a long process of recognition inside Israel. Scribes guarded writings already judged to be from God. Prophets were measured by whether their words came true. Books were checked against what God had already said. Jesus inherited that collection and taught from it as Scripture.
That shifts the burden of the argument. The council story asks you to distrust the Old Testament because of who supposedly voted. The actual record raises a harder and more honest question: were these good tests, and do the books pass them? Fulfilled prophecy, internal consistency and agreement with earlier revelation can all be examined by anyone willing to open the text and look.
