Read quickly in a modern translation, Deuteronomy 22:28–29 sounds like a sentence passed on the victim. A man assaults a young woman, pays her father, and keeps her for life. Read in its own wording and beside the earlier law it expands, the passage says something narrower. The obligation it creates falls on the man. Its verb differs from the one Deuteronomy uses for a forcible assault three verses earlier. And the parallel law in Exodus lets her family refuse him and keep the payment. Interpreters disagree about whether the case is rape, but on either reading the text does not command the woman to marry the man.
That answer depends on reading slowly, and the verse is usually passed around as a single line with no context. Dr. Jo Vitale, an Old Testament scholar whose research has focused on how women are portrayed in the Hebrew Bible, treats it as a legal text to be read beside its neighbors. Her reading is careful but not the only one, and its strengths and its limits both deserve a fair hearing.
What the Verse Actually Says
Start with the words themselves. In the King James Version, the passage reads:
“If a man find a damsel that is a virgin, which is not betrothed, and lay hold on her, and lie with her, and they be found; Then the man that lay with her shall give unto the damsel’s father fifty shekels of silver, and she shall be his wife; because he hath humbled her, he may not put her away all his days.” (Deuteronomy 22:28–29)
Four details stand out. The man “lay hold on her,” which describes him taking the initiative. The couple “be found,” so the case comes to light through discovery. He “hath humbled her,” an older English way of saying he has shamed or wronged her, which many modern translations render “violated.” And the sentence ends with a restriction on him: he may never send her away. Every command in the verse is aimed at the man. He pays, he takes responsibility, and he loses the right to divorce. The woman is given no instruction at all.
That last point is easy to miss. A law that orders a victim to do something would address her. This one addresses the man who caused the situation.
Why Do the Three Verses Before It Matter?
Verses 28–29 are the end of a short series of cases, and they read differently once you see the whole sequence. Verse 22 deals with adultery that is plainly mutual: “If a man be found lying with a woman married to an husband, then they shall both of them die.” Verses 23–24 deal with a betrothed woman in a town. Then verses 25–27 turn to a betrothed woman in the countryside:
“But if a man find a betrothed damsel in the field, and the man force her, and lie with her: then the man only that lay with her shall die.” (Deuteronomy 22:25)
The reason follows two verses later:
“For he found her in the field, and the betrothed damsel cried, and there was none to save her.” (Deuteronomy 22:27)
Vitale draws out what that case does. In her summary, where the woman’s guilt cannot be shown, “she’s the one who’s presumed innocent while the man is held guilty.” The law gives her the benefit of the doubt and reserves the harshest penalty for him alone. The passage directly above the controversial verse already recognizes sexual assault, names the woman as the one who cried for help, and punishes only the attacker.
Verse 28 is worded differently. Vitale reports that in this verse “it doesn’t actually use the typical word for rape.” She describes the term as “kind of like to take hold of somebody.” When a single chapter describes a forcible assault in one case and then uses different language a few lines later, the most natural explanation is that the author is describing a different situation.
That difference also explains the lighter penalty. Vitale says the case carries no death sentence because “a previous relationship hasn’t been broken, like in the case of adultery,” and because force cannot be proven. She does not treat that as leniency. In her words, “it is still a profoundly serious offense.”
Is “Lay Hold on Her” Just a Softer Phrase for the Same Act?
This is where the real interpretive disagreement lies. Vitale does not claim the verb describes something gentle. “So on the one hand, it’s certainly implying he is physically initiating.” Her argument turns on the phrase “they be found.” In verse 25 the law speaks of him alone: he finds her, he forces her. In verse 28 the discovery is plural. Both of them are caught, which places both inside the act at the moment it comes to light. Vitale takes that shift as a sign that the encounter has become, in some degree, mutual. Her conclusion is deliberately modest: “So it’s actually an unclear situation.”
The strongest objection comes from the passage itself. Verse 29 says the man “hath humbled her,” and many translators take that as the language of real violation. That is why several modern versions say outright that he “rapes” her. The translation Vitale read aloud when she took up this question does exactly that. The plural “they be found” can also be read simply as how the case becomes known, a matter of evidence rather than consent. On that reading, verses 28–29 describe an assault on an unbetrothed girl, and the difference from verse 25 is her legal status, not the nature of the act.
Faithful readers land on both sides of this, and the text does not settle it with certainty. What the comparison does establish is narrower but still significant. Deuteronomy has a clear category for forcible assault, and verse 28 is not written in that category’s language. A reading that treats the verse as the Bible’s whole teaching on rape ignores the case placed directly above it.
What Does the Parallel Law in Exodus Add?
Deuteronomy often restates and expands earlier laws, and Vitale argues that is happening here: “Deuteronomy 22 actually goes together with Exodus 22, verse 16 to 17.” That earlier law reads:
“And if a man entice a maid that is not betrothed, and lie with her, he shall surely endow her to be his wife. If her father utterly refuse to give her unto him, he shall pay money according to the dowry of virgins.” (Exodus 22:16–17)
The verb there is “entice.” In Exodus, as Vitale puts it, “the emphasis is on seduction.” More important for the question at hand, Exodus states outright what Deuteronomy assumes: the marriage can be refused. If the father refuses, the man still pays the full amount. Vitale’s conclusion follows from that clause. “She does not have to marry him,” because “the father himself has to also give his consent.”
Why the father? Vitale’s answer is that “as a young virgin, the girl is likely a minor,” and the family’s veto means “she can’t be manipulated or forced into the marriage.” She gives examples of when the family would say no: if the man is already married, if he is unsuitable, or if she would be unsafe with him. “But even if they refuse, the family still get to keep the money.” She goes further and argues the payment was meant to serve the young woman herself: “It’s for her safety, her provision, and her care in life.”
The limits here should be stated honestly. Deuteronomy does not repeat the refusal clause, so this reading depends on taking the two laws together, which is a reasonable inference but still an inference. The claim about where the money ended up in practice is Vitale’s historical judgment, and neither verse states it. Neither text records the young woman’s own voice either. The safeguard runs through her family. That was a real protection in a world where a father’s refusal carried legal weight, and it still falls short of the personal consent a modern reader would expect.
Who Was This Law Built to Protect?
Vitale brings one question to every law code in Scripture: “if this is a law code in particular, it’s always really good to ask the question, who is it protecting?” Her reason is simple. When people read ancient law, “We focus on the punishment so often that we miss out on what is the law protecting.”
Applied to this passage, the question changes what you notice. The man cannot use the woman and leave. Vitale reads the law as “intended as a deterrent for a man that actually can’t just sleep with any woman and then just leave her and abandon her.” He cannot pay a reduced price because of the circumstances; he owes the full amount. And he can never divorce her. Each of those clauses closes an exit that would otherwise be open to him. Meanwhile her family keeps an exit he does not have: they can refuse, and the payment stays with them. In every case in Deuteronomy 22, the heaviest burden of the law lands on the man.
Vitale is also plain about the kind of situation this is: “Now, it’s not an ideal situation.” Most of these laws, she explains, are case law, rulings for situations that have already gone wrong, where “God is trying to manage the situation to preserve and protect people as far as possible in a messy, bloody broken world.” Dr. Esau McCaulley, speaking in the same conversation about the divorce provisions Jesus discusses in Matthew 19, makes a related point about Deuteronomy’s laws for broken situations: “So the passages in Deuteronomy are what happens when things go awry.” Jesus answered the question about divorce by going back to creation, not to the exception clauses. Read that way, Deuteronomy 22:28–29 places a restraint on a man who has already done wrong. It tells us nothing about what God intends sexuality or marriage to be.
What Follows for a Reader Today
The passage describes a legal remedy in ancient Israel. It commands nothing of a woman living now, and no faithful use of it could tell a survivor of assault to marry the person who harmed her. Christians hold different views on how the law of Moses applies after Christ. Vitale’s own view is that reading the law codes, a believer knows “these don’t apply to me in the same way today,” while still learning from them about God’s character. Whatever view a reader holds, the remedy in this verse was framed for a specific society, and the text itself leaves the marriage open to refusal.

The viral reading asks what happens to her. The text keeps answering what happens to him. He pays, he cannot leave, and he cannot force the outcome. Her family can say no. A reader can still find the arrangement foreign or hard, and that reaction is honest. But the claim that the Bible hands women to their attackers has to skip the case in verse 25, the verb in verse 28, the refusal clause in Exodus, and the fact that every obligation in the passage falls on the man.
