The daughters of Zelophehad were five sisters from the tribe of Manasseh: Mahlah, Noah, Hoglah, Milcah and Tirzah. Their father died in the wilderness without sons, just as Israel was about to divide Canaan among its families. The sisters asked Moses for their father’s share. God ruled that they were right and turned their case into a law for all Israel. Numbers 36 later limited whom heiresses could marry. It never took the inheritance back.
That last sentence is where most readings go wrong. Some readers stop at Numbers 27 and treat it as a simple victory. Others read Numbers 36 as the moment the victory is quietly undone. Quonekuia Day, who teaches Old Testament at Gordon-Conwell Theological Seminary and wrote a chapter on this passage, insists the two chapters belong together. As she puts it, “You can’t stop there.” Read as one case, they show what God’s verdict reveals about his justice toward these women.
Why Did a Request for Land Carry So Much Weight?
The petition grows out of the chapter before it. Numbers 26 records a second census of Israel, taken on the edge of the promised land. That census lists Zelophehad’s daughters by name in Numbers 26:33, a striking detail in a list built around fathers and sons. The same chapter explains that the land will be divided by the names of the tribes and families (Numbers 26:52–56). Land followed the name. A man with no son had no one to carry his name into the allotment.
The stakes were concrete. Without a father and without brothers, Day observes, the women risked entering the promised land with no place to live. They were asking to stay on the map of Israel at all.
Their speech is short and carefully built. Numbers 27:3 says their father “was not in the company of them that gathered themselves together against the LORD in the company of Korah; but died in his own sin, and had no sons.” They answer an objection before anyone raises it. Korah’s rebellion in Numbers 16 was a direct challenge to God’s appointed order. Had Zelophehad joined it, his household’s claim might be suspect. He did not. He died as the rest of the wilderness generation died, and nothing in his record forfeits his family’s place.
Then comes the question at the center of the case:
“Why should the name of our father be done away from among his family, because he hath no son? Give unto us therefore a possession among the brethren of our father” (Numbers 27:4).
The sisters never call the system evil or inheritance by name meaningless. They argue from inside the system’s own logic. If the allotment exists to preserve each family’s name, a rule that wipes out a faithful man’s name because he had daughters defeats its own purpose.
What Exactly Did God Say?
Moses does not decide. Numbers 27:5 says only, “And Moses brought their cause before the LORD.” The leader who carried the law down the mountain had no precedent for five women standing at the door of the tabernacle, and the text shows him taking the question higher.
The answer comes in Numbers 27:7:
“The daughters of Zelophehad speak right: thou shalt surely give them a possession of an inheritance among their father’s brethren; and thou shalt cause the inheritance of their father to pass unto them” (Numbers 27:7).
Day sums up the moment simply: “God turns around and says, the women are right.” She explains the Hebrew behind the KJV’s “speak right” as carrying the sense of just, or correct. The weight of the verdict lies in who gives it and about what. The God of Israel looks at a petition that exposed a gap in his own people’s practice and calls the argument correct.
God then goes further than the sisters asked. Their request was for themselves. The ruling becomes general law in Numbers 27:8: “If a man die, and have no son, then ye shall cause his inheritance to pass unto his daughter.” Verses 9–11 set out the full order of succession, through brothers, uncles and the nearest kinsman, and call the arrangement “a statute of judgment” for the children of Israel (Numbers 27:11). One family’s petition reshapes inheritance law for every family in the nation.
Day draws out the practical result: “So women now can inherit without being married, if there are no sons in the family, they can inherit, they can have land, they have property, they can be fairly independent.” She adds a realistic caution. In that world, an Israelite woman would not ideally remain unmarried, so the sisters can be expected to marry. Her point concerns the legal condition. The ruling in chapter 27 does not make marriage the price of inheritance.
Does Numbers 36 Take Back What Numbers 27 Gave?
Numbers 36 opens with a new petition. The heads of the families of Gilead, the clan within Manasseh to which Zelophehad belonged, bring Moses a problem the first ruling created (Numbers 36:1–4). If the daughters marry men from another tribe, the land goes with them. Their children would belong to the husband’s tribe, and Manasseh’s allotment would shrink for good. Even the year of jubilee, which normally returned land to its original family, would not fix it, because the land would now be counted to the other tribe.
Moses answers in Numbers 36:5: “And Moses commanded the children of Israel according to the word of the LORD, saying, The tribe of the sons of Joseph hath said well.” Then comes the ruling itself:
“This is the thing which the LORD doth command concerning the daughters of Zelophehad, saying, Let them marry to whom they think best; only to the family of the tribe of their father shall they marry” (Numbers 36:6).
Day describes how womanist interpreters tend to read this chapter: as a case of women being forced to marry, a patriarchal correction to the gain of chapter 27. In these readings, she notes, Moses earns credit in chapter 27 for taking the women’s case to God, then draws criticism in chapter 36 because he seems not to consult God this time. Day disagrees with that reading of the chapter: “I don’t see the Numbers 36 passage as a command that they must marry in order to inherit.”
The wording of the chapter backs her up. The ruling narrows the pool of husbands and leaves the right to inherit untouched. Nothing in Numbers 36 cancels, reduces or conditions the daughters’ claim. The land stays theirs, and the only open question is which tribe their children will belong to. The text also frames the instruction as divine. Verse 5 says Moses spoke according to the word of the LORD, so a reader who finds the restriction hard still has to reckon with the passage presenting it as God’s ruling rather than Moses acting on his own.
The shape of the two verdicts points the same way. In chapter 27 the Lord says the daughters “speak right.” In chapter 36 the tribe of Joseph “hath said well.” God affirms the women’s claim, and later he affirms the tribe’s concern. The second affirmation sits alongside the first and fits the new law into the older promise that each tribe would keep its own land, a principle Numbers 36:7 spells out.
There is even a grant of choice inside the limit: “Let them marry to whom they think best.” The constraint is real, and so is the freedom within it. Numbers 36:10–11 records that the daughters did as the Lord commanded and married sons of their father’s brothers. The narrative tells us they obeyed. It does not tell us how they felt about it, and a careful reader should leave that silence alone.
Whose Land, and Whose Interest?
Day also describes a postcolonial line of questioning among feminist interpreters. These readers notice that the daughters are bargaining for land that other women, the women of Canaan, already live on. If the story celebrates women’s agency, whose loss pays for it?
Day calls this a fair and good question. Her answer is that it overlooks how the text frames the land: “It’s not like they’re going to take land that they are not promised.” She adds that “God has a very dim view of the Israelites when they try to take land, which is not part of their inheritance.” In her reading, the land is an allotted gift with boundaries, and God does not endorse the open-ended expansion other nations pursued.
That answer explains the logic of Numbers and keeps the daughters’ claim inside the limits of a promise. It does not try to settle every moral question about the conquest narratives, which is a separate and serious subject. For this passage the narrower point holds: the sisters ask for a share of an allotment God had already assigned.
The strongest challenge to a celebratory reading goes deeper. Day cites Katharine Doob Sakenfeld’s observation that the daughters are trying to preserve their father’s name. So, Day asks, does the outcome really benefit the women, or the man?
The honest answer is both, and the text does not pretend otherwise. The ruling works inside a patrilineal system. It preserves a man’s name, keeps land in a tribe, and later shapes the daughters’ marriages. A reader looking for a modern charter of women’s rights will not find it here.
Yet the text also does things it did not have to do. It names five women in a census of men. It lets them speak in the most formal setting in Israel. It records God calling their argument correct. And it puts land into women’s hands as standing law. The father’s name survives because the daughters hold the property. God’s justice here leaves the structure in place and corrects it at the exact point where it would have wronged the people it was meant to protect.
What Does the Verdict Reveal About God?
The plainest lesson concerns faithfulness. The reading Day wants to develop looks at “how God keeps his promises.” God promised land to every family of Israel. When the mechanism for distributing it would have left a faithful family out, God adjusted the mechanism and kept the promise. In Joshua 17:3–4 the daughters come before Eleazar the priest and Joshua, remind them of what the Lord commanded through Moses, and receive their inheritance.
The second lesson concerns who gets heard. These women had no husband, brother or father to speak for them, so they spoke for themselves, together. Day notes that interpreters have wondered what the assembly thought when five women arrived with that kind of boldness, and she draws from it a call for the church to act boldly as a group rather than alone.
Even the imperfect leader serves the story. Readers who think Moses handled chapter 36 badly can still see, Day argues, that God used him to open the door for the women. “We do not have to be perfect for God to use us,” she says.
None of this makes Numbers 27 a modern inheritance code. It is case law for Israel’s land at a particular moment. What carries forward is a portrait of God: he lets the overlooked argue their case, calls a correct argument correct, and changes his people’s practice so that no faithful household drops out of his promise.
Both rulings in this story began the same way: someone brought Moses a problem the existing practice could not solve. The inheritance law of Numbers grew through those hard questions, and God answered each one. The daughters of Zelophehad show that a question from the people a rule has overlooked is no threat to God’s justice. It is one of the ways his justice comes into view.
